Formal & substantive conceptions of the Rule of Law - Craig, P
Craig's piece makes an attempt to create a pathway through the conflicting theories of the Rule of Law. In particular he concerns himself with those which are formal (conceived and boosted by Dicey and Raz), against those which look to go further by using the concept of a substantive theory (distinguishing between 'good' and 'bad' laws dependent on whether they comply with the rights from the Rule of Law) from Unger and Dworkin. [1997] Pub Law 467
