The judicial use of the principles of EC environmental policy - Doherty, M.G.
Doherty argues within his article that the judicial use of the environmental principles is both legitimate and consistent with the European Court of Justice's general adjudicative methods. The author examines the approach of the Court to these principles of EC environmental policy, whilst looking at the Court's jurisprudence on various issues including the legal basis for legislation, free movement of goods and the judicial review of Community secondary legislation.
