Warbrick takes a look at the absence of a definition of 'terrorism' in international law. This absence is gaping within the European Convention of Human Rights as well as the European Court of Human Rights, yet he notes, this doesn't stop an increasing body of case law which 'imposes human rights constraints on States in their response to particular terrorist acts'. The author considers the relevant jurisprudence in relation to key rights: rights to life, fair trial, freedom of expression amongst others.
