Case comment: Family and children: Refusal to renew residence permit
This comment looks at Boultif v Switzerland (2001) 33 EHRR 50. The case concerns an Algerian national, who on visiting Switzerland on a tourist visa, subsequently married a Swiss citizen. Boultif was imprisoned after committing robbery and damage to property amongst other crimes and the Swiss authorities refused to renew his residence permit. Boultif was forced to leave the country and alleged that the refusal to renew his permit breached article 8 of the European Convention on Human Rights, because it resulted in the separation of his marriage.
